1. Acceptance of Terms

Welcome to WatchMyCal. These Terms of Service ("Terms") govern your access to and use of the WatchMyCal mobile application ("App") ("Company," "we," "our," or "us").

By downloading, installing, or using WatchMyCal, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

WatchMyCal is an AI-powered mobile application designed to help users track their calorie and macro intake. The App provides features including but not limited to:

• AI Meal Snap: Photograph meals to receive estimated calorie and macro breakdowns
• AI Nutrition Coach: Conversational AI for meal advice and nutritional insights
• Progress Tracking: Daily tracking, streaks, and achievement systems
• HealthKit Integration: Sync with Apple HealthKit for comprehensive health tracking

4. Account Registration

To use WatchMyCal, you must create an account using Google Sign-In. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use the App.

5. Subscription Terms

5.1 Free Trial

We offer a 7-day free trial for new users. During the trial period, you will have access to all premium features. Your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.

5.2 Subscription Plans

WatchMyCal offers the following subscription plans:

• Monthly Plan: $4.99 per month
• Yearly Plan: $29.99 per year (approximately $2.49 per month)

Prices may vary by region and are subject to change. Current prices are always displayed in the App.

5.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

5.4 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Upon cancellation, you will continue to have access to premium features until the end of your current billing period. No refunds will be provided for partial subscription periods.

5.5 Free Features

Certain basic features may be available without a subscription. Premium features, including unlimited AI Meal Snaps and AI Nutrition Coach access, require an active subscription.

6. User-Generated Content

6.1 Your Content

You retain ownership of all content you submit to the App, including meal photos and nutrition logs ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing and improving our services.

6.2 Responsibility

You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to submit your User Content and that it does not violate any third-party rights or applicable laws.

7. Acceptable Use Policy

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the App or servers connected to the App
• Upload viruses, malware, or other malicious code
• Use automated systems or software to extract data from the App (scraping)
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to harm, threaten, or harass others
• Submit false, misleading, or inappropriate content
• Circumvent any technological measures designed to protect the App
• Share your account credentials with others or allow multiple users on a single account

Violation of this Acceptable Use Policy may result in termination of your account without refund.

8. Intellectual Property

The App, including its design, features, functionality, code, and content (excluding User Content), is owned by WatchMyCal and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

The WatchMyCal name and logo are trademarks of WatchMyCal. You may not use these without our prior written consent.

9. Third-Party Services

The App may integrate with or contain links to third-party services, including Apple HealthKit, Google Sign-In, and payment processors. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind
• We do not warrant that the App will be uninterrupted, error-free, or secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim

11. Indemnification

You agree to indemnify, defend, and hold harmless WatchMyCal and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account and access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or by other means. Your continued use of the App after such changes constitutes acceptance of the modified Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in India.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WatchMyCal regarding your use of the App.
