Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and WatchMyCal ("WatchMyCal," "we," "our," or "us") governing your access to and use of the WatchMyCal mobile application and related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority in your jurisdiction), you may only use the Service with the involvement and consent of a parent or legal guardian. The Service is not intended for children under 13, and we do not knowingly collect personal information from children under 13.

By using the Service, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and truthful.

3. Account Registration

To access certain features, you must create an account using your email address (with a one-time verification code sent to your inbox) or Google Sign-In. We do not use passwords. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your account credentials (verification codes, Google account) secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for unauthorized purposes.

4. Subscription and Billing

4.1 Free Trial

New users may be eligible for a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee.

4.2 Subscription Plans

WatchMyCal Pro is offered on a subscription basis:

• Monthly Plan: $6.99 USD per month
• Annual Plan: $49.99 USD per year

Prices may vary by region and may change over time. Regional pricing, applicable taxes, and currency conversions are handled by the Apple App Store or Google Play Store.

4.3 Billing and Auto-Renewal

All subscriptions are billed through and managed by the Apple App Store or Google Play Store ("App Store"), depending on where you downloaded the Service. By subscribing, you authorize the App Store to charge your payment method at the start of each billing period.

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. The renewal charge will be the then-current subscription price.

4.4 Cancellation

You may cancel your subscription at any time through your App Store account settings:

• iOS: Settings → [Your Name] → Subscriptions → WatchMyCal
• Android: Google Play Store → Profile → Payments & Subscriptions → Subscriptions → WatchMyCal

Cancellation takes effect at the end of the current billing period. You will continue to have access to Pro features until the period ends.

4.5 Refunds

All subscription fees are non-refundable except where required by law. Refund requests are processed by the App Store, not by WatchMyCal. To request a refund:

• Android: Visit play.google.com/store/account

We do not control refund decisions made by the App Stores.

4.6 Price Changes

We reserve the right to change subscription prices. If we increase the price of your subscription, we will notify you before the change takes effect. If you do not agree to the new price, you may cancel your subscription before the next billing cycle.

5. Health and Nutrition Disclaimer

WatchMyCal is not a medical device and does not provide medical advice, diagnosis, or treatment. The Service provides nutrition and fitness tracking information for general wellness and informational purposes only.

5.1 Estimates Are Approximate

Calorie counts, macronutrient breakdowns, portion estimates, calorie burn calculations, and goal recommendations provided by the Service are approximations generated by AI and algorithmic models. They may differ, sometimes significantly, from actual nutritional content or energy expenditure. You should not rely on these estimates for medical, clinical, or therapeutic purposes.

5.2 Consult a Professional

Before starting any diet, weight loss program, exercise routine, or making significant changes to your nutrition, consult a qualified healthcare provider — especially if you have, or suspect you may have, any medical condition, including but not limited to: diabetes, eating disorders, heart conditions, kidney disease, food allergies, pregnancy, or if you are taking prescription medication.

5.3 Not For Emergency Use

The Service is not designed for, and must not be used in, medical emergencies. If you are experiencing a medical emergency, contact your local emergency services immediately.

5.4 Your Responsibility

You are solely responsible for your dietary, nutritional, and exercise decisions. You use the Service at your own risk. We are not liable for any adverse health outcomes, injuries, or other consequences arising from your use of the Service or reliance on information it provides.

6. AI-Generated Content

The Service uses artificial intelligence to identify foods, estimate portions and calories, analyze progress, and generate coaching responses. You understand and agree that:

• AI outputs may be inaccurate, incomplete, or inappropriate for your specific situation
• The AI Nutrition Coach provides general information, not personalized medical or clinical advice
• You should use independent judgment when acting on any AI-generated suggestion
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content

7. User Content and Conduct

7.1 Your Content

You retain ownership of the content you submit to the Service, including meal photos, weight logs, workout logs, notes, and other inputs ("User Content"). By submitting User Content, you grant WatchMyCal a worldwide, non-exclusive, royalty-free license to use, process, store, reproduce, and display your User Content solely for the purpose of operating and improving the Service.

7.2 Meal Photos

Meal photos are processed by our AI system to generate nutrition estimates. As described in our Privacy Policy, meal photos are not stored permanently on our servers after processing.

7.3 Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Attempt to gain unauthorized access to our systems, other users' accounts, or our AI models
• Use automated means (bots, scrapers) to access or interact with the Service
• Submit content that is illegal, infringing, harmful, or that contains malware
• Use the Service to distribute spam or unsolicited communications
• Resell, redistribute, or commercially exploit the Service or its content
• Attempt to manipulate or deceive the AI systems (e.g., submitting false images to distort nutrition estimates)
• Circumvent any technical or access restrictions of the Service
• Use the Service in any way that could damage, disable, overburden, or impair our systems

8. Intellectual Property

8.1 Our Rights

The Service, including its software, design, features, branding, trademarks, logos, and all content we provide (excluding User Content), is owned by WatchMyCal or our licensors and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

8.2 License to You

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes.

8.3 Feedback

If you provide us with suggestions, feedback, or ideas about the Service, you grant us the right to use them freely, without compensation or obligation to you.

9. Third-Party Services

The Service integrates with third-party services including Apple App Store, Google Play Store, Apple HealthKit, Supabase, RevenueCat, Sentry, PostHog, Google Sign-In, and Google Gemini API. Your use of these services is governed by their own terms and privacy policies. We are not responsible for the practices, content, or availability of third-party services.

10. Apple App Store Additional Terms

If you downloaded the Service from the Apple App Store, the following additional terms apply:

• These Terms are between you and WatchMyCal only, not with Apple. Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support for the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims by you or any third party relating to the Service.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Google Play Store Additional Terms

If you downloaded the Service from the Google Play Store, your use is also governed by the Google Play Terms of Service.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Termination

You may stop using the Service at any time. To delete your account and all associated data, you can use the in-app deletion feature (Settings → Delete Account) or email privacy@watchmycal.com.

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive behavior, or for any other reason at our sole discretion. Upon termination:

• Your right to use the Service will immediately cease
• Any active subscription will continue until the end of the current billing period (we do not provide refunds for early termination unless required by law)
• Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, secure, or free of viruses
• Warranties regarding the accuracy, reliability, or completeness of AI-generated content, nutrition estimates, or coaching information
• Warranties that the Service will meet your requirements or produce any particular health, fitness, or weight-related outcome

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WATCHMYCAL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to:

• Your use of, or inability to use, the Service
• Any health, weight, nutritional, or fitness outcomes (or lack thereof)
• Inaccuracies in AI-generated nutrition estimates or coaching content
• Unauthorized access to or alteration of your data
• Any third-party conduct or content

In no event shall our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless WatchMyCal and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any User Content you submit

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

If you are a consumer in the European Union, United Kingdom, or another jurisdiction whose laws grant you mandatory consumer rights, nothing in these Terms limits those rights.

Similarly, if you are a consumer in the United States, California, Washington, or another jurisdiction with mandatory consumer or privacy rights, nothing in these Terms limits those rights.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, by providing in-app notice or email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WatchMyCal regarding the Service and supersede all prior agreements and understandings.
